Thank you for using markepers ("Service"). This Service is developed and provided by markepers ("we", "us" or "our"). By using the Service, you are deemed to agree to these Terms of Service ("Terms") and other related policies that we may publish from time to time. markepers is an AI-powered data analysis platform that analyzes and visualizes data from Excel, CSV files, Google Sheets, and Instagram/Meta integrated accounts. With markepers you can:
markepers is currently offered free of charge and does not operate any paid subscription or payment system. If paid features are introduced in the future, we will provide advance notice and update these Terms accordingly.
To maintain service stability, monthly usage limits (e.g., based on AI token cost) may apply to AI analysis requests. Once the monthly limit is reached, additional AI analysis features may be temporarily restricted for that month and will automatically resume the following month.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or business/professional use.
You may not resell, sublicense, or redistribute the Service or any output derived from it, in whole or in part, without our prior written consent. You may also not modify, distribute, or create derivative works based on the Service without our explicit written permission.

All content and software associated with the Service are the property of markepers or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property rights laws.
Ownership, rights, and interest in content generated by markepers' AI ("Outputs") belong to you. However, you agree to grant markepers an unlimited, transferable, sublicensable, irrevocable, royalty-free license to use for the following purposes only:
You additionally grant markepers a royalty-free license to use your username, image, voice, and likeness to identify the source of your Outputs.
Due to the nature and characteristics of AI and machine learning, Outputs you generate may have certain similarities to other Outputs generated by other users of markepers. That is, markepers does not guarantee the uniqueness of the Outputs you obtain.
Due to the peculiarities and complexity of AIGC and the uncertainty of copyright law, markepers does not guarantee that Outputs generated using markepers can be used for copyright registration. You acknowledge that you voluntarily assume all risks that may arise from such legal risks (such as inability to register copyright, etc.) and adverse changes in subsequent laws and regulations.
With respect to data files, records, other content, or materials you upload or post (collectively "User Content"), you represent and warrant that you own all rights, title, and interest (including copyright and publicity rights) in such User Content or have the right to use it for such purposes through license or legal exception or limitation.
You represent and warrant that: - You own the User Content you post to the Service or have the right to grant the license specified in these Terms. - Posting and using your User Content on the Service does not infringe upon privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or other rights of any individual. - Posting your User Content on the Service does not require obtaining additional licenses from third parties or paying royalties, fees, compensation, or other amounts, or providing attribution.
By submitting User Content through the Service, you grant markepers an unlimited, transferable, sublicensable, revocable, royalty-free license for the following purposes:

If you find Inappropriate Content, please immediately email markepers at the contact information in Section 18 or report it through the features provided in the Service.
To the maximum extent permitted by applicable law, markepers, its affiliates, officers, directors, employees, agents, suppliers, or licensors (collectively "markepers Parties") shall not be liable for:
You acknowledge and agree that artificial intelligence and language models can produce unpredictable outputs and may generate incorrect, harmful, offensive, or otherwise undesirable content. We make no warranties about, and accept no liability for, any outputs, recommendations, analysis, or decisions generated by the AI components of our Service. You are solely responsible for evaluating and verifying any information or suggestions provided by the Service, and for any actions you take based on the Service's outputs.
The Service may automatically make API calls or use third-party services that incur costs or charges. You acknowledge and agree that we are not responsible for any fees, charges, or costs resulting from such automated actions or API usage, including but not limited to situations where the AI model initiates API calls or performs actions that result in charges to your account or connected services. You are solely responsible for monitoring and managing any costs associated with your use of the Service and any integrated third-party services or APIs.
In no event shall the liability of the markepers Parties to you or any third party exceed the greater of the fees you have paid us for credits and USD $100.

The Service may include integrations with third-party services such as Google Sheets, Excel, etc. When enabling third-party services, you must comply with additional terms and conditions, privacy policies, or other agreements with such third parties. markepers has no control over third-party services and is not responsible for the accuracy, availability, reliability, or completeness of third-party services.
All costs and fees associated with using third-party services are your responsibility, not markepers'.
markepers respects the intellectual property of others and takes intellectual property protection very seriously, and requests that users do the same.

We may change these Terms at any time without prior notice. However, we will make efforts to provide at least 30 days' notice of material changes that may apply to you.
After revision, we will post the revised Terms and update the "Last Updated" date above. Unless otherwise stated, the revised Terms will take effect immediately upon posting, and your continued use of the Service after notice will confirm your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

If you wish to delete User Content from the Service, you may delete it using the permitted features of the Service, but the removal or deletion of such User Content does not terminate these Terms.
These Terms and your use of the Service shall be governed by the laws of the Republic of Korea and interpreted without regard to conflict of laws principles.
Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court of the Republic of Korea.
